Perlindungan Hukum Terhadap Hak Narapidana Wanita Hamil Perspektif Hukum Positif dan Hukum Islam (Studi Kasus Lembaga Pemasyarakatan Kelas II A Jember)

This research aims to understand the fulfillment of the rights of pregnant female prisoners at the Class II A Correctional Institution in Jember and the views of positive law and Islamic law regarding legal protection for the rights of pregnant female inmates. The research method used is empirical legal research (field research) with a juridical-empirical approach through observation, interviews, and document studies, including photos and documents, to collect accurate data from selected sources.
The conclusion of this study is: 1) The fulfillment of rights for pregnant female inmates at Class II A Correctional Institution Jember includes regular health check-ups, provision of supplementary food and special formula milk for pregnant mothers, and other rights granted according to the institution's capability; 2) The perspective of positive law regulating the rights of pregnant female prisoners focuses on the provision of special food and special treatment, as stated in Law No. 22 of 2022 and Government Regulation No. 32 of 1999, while Islamic law explains protection for the rights of pregnant female prisoners in the form of postponement of detention period or the application of the maqashid shari’ah concept.
