Penggunaan Dokumen Elektronik sebagai Alat Bukti dalam Tindak Pidana Prostitusi di Media Sosial

This research has two main objectives. First, to describe and explain the legal regulations in Indonesian legislation concerning electronic evidence closely related to online prostitution crimes on social media. Second, to analyze the procedures and processes used in trials regarding the use of electronic evidence in the form of electronic documents for prosecuting prostitution offenses on social media. This study employs normative juridical research with a statutory approach and a conceptual approach. The data collection technique used is document or literature study of existing legal materials.
The research findings show that, first, electronic evidence is specifically regulated in the provisions of electronic information laws. Electronic evidence can consist of information such as important documents and other information within the electronic scope. The legality of electronic evidence is not only found in the Electronic Information and Transactions Law (UU ITE) but is also accommodated by regulations outside this law. The difference lies in whether such evidence is placed as independent evidence or as supporting evidence. Second, the resolution of online prostitution criminal cases on social media refers to UU ITE provisions as the basis for using electronic evidence. However, the overall criminal procedure, from examination to subsequent resolution efforts, still refers to the Criminal Procedure Code (KUHAP).
